Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Knives Mystery Box LLC ("Mystery Knives," "we," "us," or "our"). They apply to your use of mysteryknivesbox.com (the "Site") and to every order you place with us.

Please read these Terms and the policies listed below in full before checking out. By using the Site, checking the box at checkout, or placing an order, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the Site or place an order.

IMPORTANT: SECTION 25 CONTAINS A BINDING INDIVIDUAL ARBITRATION AGREEMENT AND A CLASS-ACTION AND JURY-TRIAL WAIVER THAT AFFECT YOUR LEGAL RIGHTS. SECTIONS 11 AND 20 THROUGH 22 DISCLAIM WARRANTIES, LIMIT OUR LIABILITY, AND REQUIRE YOU TO ASSUME RISKS AND INDEMNIFY US.

1. AGE REQUIREMENT AND ELIGIBILITY: 18 AND OLDER ONLY

The Site and our products are for adults only. By using the Site or placing an order, you certify that you are at least 18 years old and able to form a binding contract. We do not sell to anyone under 18. If you are under 18, do not use the Site or place an order, and do not ask anyone to buy for you.

If the law where you live, or where the order will be delivered, sets a higher minimum age to buy, receive, possess, or use any item (for example, 21), you certify that you meet that higher age. You also agree that every person who receives, opens, or uses the order meets the legal age and is legally allowed to have the item. You may not buy any product for, or give or transfer any product to, a minor or any person who may not lawfully possess it.

Age and identity verification. We may ask for proof of age or identity, before or after you place an order, for any order. We may delay, hold, or cancel any order if you do not provide it, or if we have reason to believe that the buyer or recipient is under age.


2. RESTRICTED ITEMS AND KNIFE LAW (INCORPORATED POLICY)

Our Restricted Items & Knife Law policy is part of these Terms and is incorporated into them by this reference, as if written here in full. You must read and agree to it before you order:

In summary, and without limiting that policy:

- You must be 18 or older (or older if the law where you live or receive the order requires it).
- You alone are responsible for knowing and obeying all federal, state, and local laws that apply to buying, receiving, owning, possessing, carrying, transporting, and using any product you order. We do not represent that any product is legal where you live, and nothing we say is legal advice.
- Where certification is required, you must confirm: "I certify that I meet an exemption under the Federal Switchblade Act and that this item is legal to receive where I live." By choosing a shipping rate that ships to your selected address or by placing any order, you certify that your order complies with all federal, state, and local laws. A false certification is a material breach of these Terms, and you are solely responsible for it and its consequences.
- Restricted knives ship only by UPS or another private carrier, never through the U.S. Postal Service.
- We may refuse, cancel, or hold any order we believe cannot be lawfully shipped or received. If we cancel for this reason, we refund the full amount paid for the canceled items. You are solely responsible for any item seized for legal reasons.

If that policy and this Section 2 conflict, the provision that gives us more protection controls.

Automatic Knives Agreement:

IN COMPLIANCE WITH FEDERAL STATUTES REGARDING INTERSTATE SHIPPING OF AUTOMATIC KNIVES, Knives Mystery Box LLC requests that you read carefully the requirements set forth below, and agree to this prior to your purchase or receipt of any automatic opening knife from our company.

Federal law prohibits shipment of automatic knives across state lines, with the following exceptions:
  1. to civilian or Armed Forces supply or procurement officers and employees of the Federal Government ordering, procuring, or purchasing such knives in connection with the activities of the Federal Government;
  2. an active Armed Forces member or employee acting in the performance of his or her duty;
  3. to supply or procurement officers of the National Guard, the Air National Guard, or militia of a State, Territory or the District of Columbia ordering, procuring, or purchasing such knives in the connection with the activities of such organization;
  4. to supply or procurement officers or employees of the municipal government of the District of Columbia or the government of an State or Territory, or any county, city or other political subdivision of a State or Territory;
  5. to manufacturers of such knives or bona fide dealers therein in connection with any shipment made pursuant of an order from any person designated in paragraphs 1, 2, 3 and 4.
  6. Knives Mystery Box LLC will not sell automatic opening knives to any customer unless such sale or receipt of Product Service return is made in compliance with one or more of the above conditions.
By signing and submitting this form, you (Knives Mystery Box LLC Customer/Buyer) hereby recognize and acknowledge that it is your responsibility as the buyer to ascertain and obey all applicable laws (local, state, federal and international) in regard to the possession or purchase of any item from Knives Mystery Box LLC. You further hereby represent and certify that your purchase or ownership of automatic opening knives from Knives Mystery Box LLC meets one or more of the criteria set forth above and agree to use these knives in connection of duties as described above in sections 1, 2, 3, 4 and 5.


Mystery Knives Box warrants the above to be true according to the best available information. Buyers shall be responsible for verifying local, states, and federal laws.


3. MYSTERY BOX PURCHASES

3.1 What you are buying. A mystery box or loadout is a curated assortment of products of the type or category stated on the product page, selected and packed by us. Every box contains the number and type of items stated on the product page for that box. You are buying that product. You are not buying a chance, ticket, or entry, and a mystery box is not a game of chance, lottery, sweepstakes, raffle, or contest. No item in any box is a "prize," and no purchase is a wager. We do not currently run giveaways, sweepstakes, or contests. 

3.2 Selection. We select every item. We have the right to select any knife, tool, gear, or other product we consider fit for the box you ordered, based on our own criteria. You cannot choose, request, or exclude a specific item, brand, model, color, size, material, or style, and any request or preference you share with us is not guaranteed.

3.3 No guaranteed value. Items vary from box to box. We do not promise that any box will contain any particular item, brand, or material, or an item of any particular retail, resale, collector, or market value, and we do not promise that the items in your box will be worth more than, or as much as, the price you paid. Any "regular price," "compare at" price, percentage-off, or "styles" figure shown on the Site describes our pricing or the range of our catalog. It is not a statement or guarantee of the value of the specific items in your box.

3.4 Images and descriptions. Product images, videos, and examples are illustrative only. They show the kind of items a box may include, not the items you will receive. We try to make product descriptions as accurate as possible, but items may differ from images in look and feel, and your screen may not show colors and details accurately. Words such as "tactical," "survival," "combat-grade," or "everyday carry" describe styles. They are not a promise that any item is suitable for any particular use.

3.5 Stock and substitutions. All items and packaging may go out of stock, even after you buy. We may substitute items of the same box type or category and may ship your order in any safe packaging.

3.6 Free items. If we include a free gift, sticker, card, or promotional item with an order, it has no stated cash value, is not part of what you paid for, and may be changed or discontinued at any time.


4. ORDERS AND ORDER ACCEPTANCE

4.1 Order acceptance. Your order is an offer to buy. An order confirmation email confirms that we received your order. It does not mean we accepted it. We accept your order when we ship it. Until then, we may decline or cancel all or part of any order for any lawful reason, including the reasons below. If we cancel after you were charged, we refund the amount charged for the canceled items.

4.2 Pricing and other errors. The Site may contain typographical errors, inaccuracies, or omissions in descriptions, pricing, discounts, shipping charges, or availability. We are not required to honor any price or offer that is clearly an error. We may correct errors at any time, even after you place an order, and may cancel any order affected by an error, with a refund of the amount charged.

4.3 Quantity and reseller limits. We may limit or cancel quantities purchased per person, per household, per account, per payment method, per address, or per order. We may limit or refuse orders that, in our judgment, appear to be placed by or for dealers, resellers, distributors, or purchasing agents. Products are sold for personal use only and not for resale.

4.4 Fraud screening and address verification. We and our payment processors may screen orders for fraud and verify billing and shipping information. Orders whose shipping address does not match the billing address, or that cannot be verified, may be delayed, require more information, or be canceled. We may cancel any order we reasonably suspect is fraudulent, unauthorized, or placed in violation of these Terms.

4.5 Cancellations, changes, and refunds. Order changes, cancellations (including our 15-minute window), returns, refunds, store credit, and the Lifetime Guarantee are governed by our Refund and Return Policy:

5. PRICES, PAYMENT, TAXES, AND PAYMENT DISPUTES

5.1 Prices. Prices are in US dollars and may change at any time without notice. The price that applies is the price shown at checkout when you place your order, subject to Section 4.2.

5.2 Payment. Payment is processed at checkout through Shopify (including Shop Pay, Apple Pay, and Google Pay where available) and is captured when you place your order. You confirm that you are authorized to use the payment method you provide, and you authorize us and our payment processors to charge it for your order, including shipping and taxes.

5.3 Sales tax. Sales tax and other applicable taxes are calculated by Shopify at checkout based on your shipping address and added to your order where required. You are responsible for any taxes not collected at checkout that apply to your purchase.

5.4 Payment disputes. If you have a problem with a charge, you agree to contact us first at team@mysteryknivesbox.com so we can try to resolve it. Our chargeback terms are in our Refund and Return Policy. We may dispute chargebacks we believe are unjustified, including by providing your order records, checkout acceptance of these Terms, any certification you gave, and tracking and delivery information. We may suspend or refuse future orders from anyone who files chargebacks we believe are unjustified. To the extent permitted by law, you are responsible for any costs we incur, including reasonable collection costs, because of a chargeback that is decided in our favor.


6. SHIPPING, TITLE, RISK OF LOSS, AND EXPORT

6.1 Shipping. Shipping methods, processing times, delivery estimates, the Fast Insured reship promise, and lost-package procedures are governed by our Shipping Policy:

Delivery dates are estimates and are not guaranteed.

6.2 Title and risk of loss. Title to products passes to you when we deliver them to the carrier. Risk of loss passes to you when the carrier marks the package delivered to the shipping address you provided. Before delivery, our only obligations for lost or damaged packages are those stated in our Shipping Policy and Refund and Return Policy (including the Fast Insured reship). After delivery, we are not responsible for loss, theft, or damage, except as those policies expressly state.

6.3 United States only. We sell and ship only to addresses in the United States. You may not export, re-export, or ship any product outside the United States, directly or through a freight forwarder, reshipper, or package-forwarding service, and you agree to comply with all U.S. export and import laws. We may refuse or cancel orders addressed to freight forwarders or package-forwarding services.


7. PRODUCT SAFETY AND WARNING

ALL BOXES CONTAIN SHARP OBJECTS. KNIVES CAN CAUSE SERIOUS INJURY OR DEATH. The Product Safety and Warning section of our Restricted Items & Knife Law policy (https://mysteryknivesbox.com/pages/restricted-items-knife-law) is part of these Terms. You agree to follow it, to open, inspect, and test every item carefully, to keep products away from children and from anyone not legally allowed or able to handle them safely, to use products only for lawful purposes, and that you are responsible for anyone you allow to use products you buy from us. We are not responsible for injuries or damage caused by unsafe, risky, improper, or unlawful use, modification, or storage, or by lack of adult supervision.

No professional advice. Nothing on the Site, in our emails, or from our team is legal, medical, safety-training, or self-defense advice. We do not recommend any product for self-defense, combat, rescue, or survival use. Get qualified training before using any knife, and get legal advice about the laws that apply to you.

CALIFORNIA PROPOSITION 65 WARNING: Products sold on this site contain chemicals known to the State of California to cause cancer and birth defects or other reproductive harm (California Health & Safety Code Section 25249.6). For more information, go to www.P65Warnings.ca.gov.


8. PROHIBITED USES

You may use the Site and our products only for lawful purposes. You agree not to:

- use any product to harm, threaten, harass, or intimidate any person or animal, or as a weapon except where the law allows;
- buy any product for, or give, sell, or transfer any product to, a minor or any person who may not lawfully possess it;
- resell products in violation of any law, or buy products for any illegal purpose;
- provide false information, including a false age, name, address, or certification, or use another person's payment method without permission;
- use a buying agent, purchasing agent, or false identity to get around our limits or restrictions;
- use bots, scrapers, scripts, or other automated means to access the Site, place orders, or collect data;
- interfere with the Site's security or operation, or upload viruses or other harmful code;
- copy, frame, or mirror the Site, or use its content to compete with us; or
- break any law or these Terms.


9. LIFETIME GUARANTEE AND OTHER PROMISES (LIMITED)

If your knife ever has a manufacturing defect or failure, like a broken lock, a loose pivot, or a faulty spring, contact us at team@mysteryknivesbox.com with your order number and a photo. We will make it right with a replacement or a refund. This covers defects and failures in normal use, not damage from misuse, accidents, modification, or normal wear such as dulling. Full terms are in our Refund and Return Policy.

The Lifetime Guarantee, the shipping-damage guarantee and missing-item terms in our Refund and Return Policy, and the Fast Insured reship promise in our Shipping Policy are the only promises we make about our products and their delivery. Your only remedies under them are the replacement, reship, refund, or store credit described in those policies. Brand-name items may also carry their manufacturer's own warranty, which is the manufacturer's responsibility.


10. NO OTHER PROMISES

No employee, agent, reviewer, creator, or other person may change these Terms or make any promise on our behalf beyond what these Terms and the linked policies state. Statements in reviews, social media posts, or videos by customers or third parties are not our promises.


11. DISCLAIMER OF WARRANTIES

EXCEPT FOR THE PROMISES DESCRIBED IN SECTION 9, AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS," "WITH ALL FAULTS," AND "AS AVAILABLE," AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY PRODUCT WILL MEET YOUR EXPECTATIONS, IS SUITABLE OR SAFE FOR ANY PARTICULAR USE, OR WILL PROTECT YOU FROM HARM, INJURY, DISMEMBERMENT, OR DEATH. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, AND WE ARE NOT RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICES OR DATA FROM USING THE SITE. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.


12. SITE LICENSE, INTELLECTUAL PROPERTY, AND TRADEMARKS

12.1 License. We grant you a limited, revocable, non-transferable, non-exclusive license to access and use the Site in your web browser only for personal shopping. You may not use the Site for any commercial purpose or on behalf of any third party unless we permit it in writing in advance. Any violation of these Terms ends this license immediately without notice.

12.2 Our content. All materials on the Site, including images, text, illustrations, designs, logos, icons, photographs, programs, music, video, downloads, and the selection and arrangement of the Site (the "Contents"), are owned by us or our licensors and are protected by copyright, trademark, and other laws. The Contents are for your personal, non-commercial use only. You may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile, or otherwise exploit the Site or any part of it unless we permit it in writing. All rights not expressly granted are reserved.

12.3 Trademarks. Mystery Knives Box, Knives Mystery Box LLC, and our product and box names, logos, and designs are our trademarks. You may not use them without our written permission, including in domain names, ads, social media handles, or keywords, or in any way likely to cause confusion. Other trademarks and brand names shown on the Site or on products are the property of their respective owners, and their appearance does not mean those owners sponsor or endorse us.


13. REVIEWS, USER CONTENT, AND FEEDBACK

13.1 Your content. You may be able to post reviews, ratings, photos, videos, or other content, including through our reviews provider (Loox), or send content to us by email or social media ("User Content"). You keep ownership of your User Content. By submitting it, you grant us and our service providers a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, fully paid, transferable, and sublicensable license to use, copy, reproduce, display, publish, modify (for example, crop or resize), translate, distribute, and create derivative works from it, with your first name and last initial or username, in any media, for any purpose connected with our business, including advertising and social media, without further notice or payment to you. To the extent permitted by law, you waive any moral rights in your User Content.

13.2 Your promises. You promise that your User Content is your own or that you have all rights needed to grant this license; that you have the consent of every identifiable person shown in it; that it reflects your honest, firsthand experience; and that it does not infringe anyone's rights or break any law.

13.3 Review guidelines. Reviews must be about your own experience with a product you bought. Reviews may not contain: false or misleading statements; profanity or abusive, hateful, harassing, or discriminatory language; personal information about others; images of minors with knives, of injuries, or of products being used to threaten or harm anyone or used illegally; advertising or links; or content posted on behalf of a competitor or in exchange for payment that is not disclosed. If we ever offer anything in exchange for a review, it will not depend on the review being positive. We may decline, remove, or edit the format of User Content that breaks these guidelines or these Terms, but we will not suppress honest reviews just because they are negative. We are not responsible for User Content, and reviews do not represent our views.

13.4 Feedback. If you send us ideas, suggestions, or feedback, we may use them for any purpose without obligation or payment to you. Please do not send us confidential information.


14. COPYRIGHT COMPLAINTS (DMCA)

We respect intellectual property rights. If you believe content on the Site infringes your copyright, send a written notice to our copyright agent by email at team@mysteryknivesbox.com (subject line "DMCA Notice") or by mail to the address in Section 30. Your notice must include: (a) your physical or electronic signature; (b) identification of the copyrighted work you claim is infringed; (c) identification of the material you claim is infringing and where it is located on the Site; (d) your name, address, telephone number, and email address; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf. We may remove material and may terminate the accounts of repeat infringers. Knowingly false notices may expose you to liability.


15. ACCOUNTS

If you create an account, you must give accurate information and keep it up to date. You are responsible for keeping your login details secure and for all activity under your account, whether or not you authorized it, including all communications and all obligations (including financial obligations) incurred through it. Tell us right away at team@mysteryknivesbox.com if you learn of any unauthorized use or security breach. We have no duty to investigate who is using your login.


16. ELECTRONIC COMMUNICATIONS AND SIGNATURES

By using the Site, placing an order, or emailing us, you consent to receive communications from us electronically, including by email and by posting on the Site. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing. You agree that checking a box, clicking a button, or placing an order is your electronic signature and has the same effect as a handwritten signature, and you agree to the electronic delivery of these Terms and your order records. You can print or save these Terms for your records. We send transactional emails about your orders. Marketing emails are sent only as described in our Privacy Policy, and you can unsubscribe at any time. We do not send SMS or text-message marketing.


17. THIRD-PARTY LINKS AND SERVICES

The Site may link to, or use, websites and services run by others, including Shopify checkout, payment providers, shipping carriers, reviews and post-purchase apps, and social media. We do not control them and are not responsible for their content, products, availability, or practices, and your use of them may be governed by their own terms and privacy policies. A link is not an endorsement.


18. PRIVACY

19. YOUR REPRESENTATIONS

Each time you use the Site or place an order, you represent that: (a) you are at least 18 years old and meet any higher age required where you live; (b) your order and your ownership, possession, and use of every item comply with all applicable federal, state, and local laws; (c) any certification you give is true; (d) you have read the product description and these Terms in full and understand what to expect; (e) the information you provide is true, accurate, and complete; (f) you are buying for your own personal use and not for resale or export; and (g) you are not barred from receiving products under any law.


20. ASSUMPTION OF RISK AND RELEASE

Knives and bladed products are inherently dangerous. YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS of injury, death, property damage, and legal consequences that arise from unboxing, inspecting, handling, using, carrying, storing, transporting, transferring, or possessing any product you buy from us, whether by you or anyone else. To the fullest extent permitted by law, you release Knives Mystery Box LLC and its owners, members, managers, employees, agents, contractors, suppliers, insurers, successors, and assigns (the "Released Parties") from all claims, demands, and liability for any such injury, death, damage, or legal consequence, including claims based on improper, illegal, or unintended use or modification of any product, and including any legal proceedings arising from your purchase or use. This release does not apply to liability that cannot be released under applicable law, such as liability for our own gross negligence or willful misconduct.

If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You also waive any similar law of any other state, to the extent permitted.


21. INDEMNITY

You agree to defend, indemnify, and hold harmless the Released Parties from all claims, demands, losses, damages, liabilities, judgments, fines, penalties, costs, and expenses (including reasonable attorneys' fees, expert fees, and court costs) arising directly or indirectly from: (a) your purchase, ownership, possession, transfer, or use of any product, whether in compliance with or in violation of any law; (b) any use of a product by any person you allow to access it; (c) any false certification or representation you make; (d) your User Content; or (e) your breach of these Terms or any law. We may take over the defense of any claim at your expense, and you will cooperate with us.


22. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW: (A) THE RELEASED PARTIES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR LOSS OF USE, ARISING FROM OR RELATED TO THE SITE, ANY PRODUCT, OR THESE TERMS, UNDER ANY LEGAL THEORY, EVEN IF WE WERE TOLD THEY WERE POSSIBLE; AND (B) THE RELEASED PARTIES' TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO ANY ORDER OR PRODUCT WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM. THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME STATES DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT FULLY APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.


23. LAW ENFORCEMENT AND LEGAL COMPLIANCE

We may report to the proper authorities anyone we believe has provided false information, attempted fraud, bought for a minor, or used or intends to use a product unlawfully. We may share information about your use of the Site and your orders with law enforcement or government authorities in response to lawful requests or legal process, or when we believe it is necessary to protect our rights, prevent harm, or comply with the law, as described in our Privacy Policy.


24. GOVERNING LAW AND VENUE

These Terms and any dispute between you and us are governed by the laws of the State of Utah and applicable federal law, including the Federal Arbitration Act, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Subject to Section 25, any court proceeding will be brought only in the state or federal courts located in Utah County, Utah, and you and we consent to their personal jurisdiction and venue.


25. DISPUTE RESOLUTION: INFORMAL RESOLUTION, INDIVIDUAL ARBITRATION, AND CLASS-ACTION WAIVER

25.1 Talk to us first. Most problems can be solved quickly by email. Before filing any claim, you agree to email team@mysteryknivesbox.com with your name, order number, a description of the problem, and the relief you want. You and we agree to try in good faith to resolve the dispute informally for at least 30 days after the notice is received. We will do the same before filing a claim against you. Any time limit for bringing a claim is paused during this 30-day period.

25.2 Binding individual arbitration. If the dispute is not resolved within 30 days, you and we agree that any dispute, claim, or controversy arising out of or relating to the Site, any product or order, or these Terms (including their formation, scope, or enforceability, and including claims for personal injury or property damage to the fullest extent permitted by law) will be resolved by final and binding arbitration, not in court. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect at the time, before a single arbitrator. The arbitration may be held by video or telephone, by written submissions, or in person in the county where you live or in Utah County, Utah. Fees are paid as set by the AAA Consumer Arbitration Rules. The arbitrator must follow applicable law and these Terms, and may award the same individual relief a court could award, but only to the individual party seeking relief and only to the extent needed to resolve that party's individual claim. Judgment on the award may be entered in any court with jurisdiction.

25.3 Class-action and jury waiver. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL. The arbitrator may not consolidate claims of more than one person. If this class-action waiver is found unenforceable for any claim, that claim must be severed and heard in court after the arbitration of any individual claims, and the rest of this Section 25 still applies.

25.4 Mass filings. If 25 or more similar arbitration demands are filed against us by or with the help of the same law firm or organization, the demands will be administered in batches under the AAA's mass arbitration procedures, to the extent permitted by those rules.

25.5 Exceptions. Either party may bring an individual claim in small claims court if it qualifies and stays there. Either party may also seek relief in court to stop infringement or misuse of intellectual property.

25.6 Opt-out. You may opt out of this arbitration agreement by emailing team@mysteryknivesbox.com within 30 days after you first accept these Terms, with the subject line "Arbitration Opt-Out" and your name, email address, and mailing address. Opting out does not affect any other part of these Terms.

25.7 Time limit. To the extent permitted by law, any claim must be brought within one year after it arises, or it is permanently barred.


26. TERMINATION

We may suspend or end your access to the Site, close your account, or refuse future orders at any time, with or without notice, if we believe you have broken these Terms or the law, or your conduct is harmful to us or others. If we do, you may not create a new account or order under another name. You may stop using the Site at any time. Ending access does not affect orders already shipped or any rights or obligations that arose before it ended.


27. STATE-SPECIFIC NOTICES

California residents. Under California Civil Code Section 1789.3, California users are entitled to the following notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210 or (916) 445-1254. New Jersey residents. Some provisions of these Terms, including certain disclaimers, limitations of liability, releases, and indemnities, may not apply to you in New Jersey or may apply only to the extent permitted by New Jersey law. Any provision that is unenforceable under New Jersey law will be limited or not applied for New Jersey residents only, and the rest of these Terms will still apply. Nothing in these Terms is meant to limit any right you have under the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act.

All residents. Where a law in your state gives you rights that cannot be waived or limited by contract, these Terms do not take those rights away, and the affected provision applies only to the extent the law permits.


28. CHANGES TO THE SITE AND THESE TERMS

We may change, suspend, or discontinue any part of the Site or any product at any time without liability. We may change these Terms at any time by posting the updated Terms on this page and updating the effective date. Changes apply to use of the Site and orders placed after they are posted. The Terms in effect when you place an order apply to that order. Material changes to Section 25 will not apply to a dispute that you notified us about before the change was posted.


29. GENERAL

Entire agreement. These Terms, together with the policies linked above, are the entire agreement between you and us about their subject matter and replace any earlier agreements or statements. If these Terms conflict with another policy, these Terms control unless that policy expressly says otherwise.
Severability. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent possible and the rest will remain in effect.
No waiver. Our failure or delay in enforcing any part of these Terms is not a waiver.
Assignment. You may not assign or transfer these Terms without our written consent. We may assign them, including in connection with a sale or reorganization of our business.
Force majeure. We are not liable for any delay or failure caused by events outside our reasonable control, including carrier delays or failures, weather, natural disasters, epidemics, labor disputes, supplier shortages, internet or utility outages, cyberattacks, changes in law, or government action.
Notices. We may give you notice by email to the address on your order or account, or by posting on the Site. You must send legal notices to us by email at team@mysteryknivesbox.com and by mail to the address in Section 30. Email notice is effective when sent and mailed notice three business days after mailing.
Relationship. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and us.
Interpretation. Headings are for convenience only and do not affect meaning. "Including" means "including without limitation." These Terms will not be construed against us because we drafted them. You waive any defense based on the electronic form of these Terms or the lack of a handwritten signature.
Survival. Sections 1 through 3, 5, 6, 7, 8, 9, 11 through 14, and 19 through 29 survive any termination of these Terms and the completion of your order.30. CONTACT US
